These Terms & Conditions ("Terms") govern the use of the KabadCart Platform, including the website, mobile application, and related services. By accessing or using the Platform, users agree to comply with these Terms.
1. Platform Nature
KabadCart is a technology platform that connects users with independent scrap collection partners, recyclers, and kabadiwalas. KabadCart itself is not necessarily the buyer of scrap material and acts primarily as a facilitator between users and collection partners.
2. Eligibility
Users must:
- be legally capable of entering into agreements,
- provide accurate details,
- and comply with applicable laws.
3. Scrap Listings & Ownership
Users confirm that:
- the scrap/material belongs to them or they are authorized to sell it,
- the material is legal,
- and no stolen or prohibited goods are being listed.
KabadCart shall not be responsible for disputes relating to ownership or legality of scrap.
4. Pricing
Prices shown on the Platform are estimated market rates derived from:
- market surveys,
- vendor analysis,
- demand conditions,
- and operational factors.
Prices are dynamic and may change without prior notice.
Final pricing may depend on:
- material quality,
- quantity,
- contamination,
- location,
- and market conditions at the time of pickup.
5. Pickup Operations
Pickup timings are tentative and may vary due to:
- traffic,
- operational load,
- weather,
- vendor availability,
- or route optimization requirements.
KabadCart does not guarantee exact pickup times.
6. Payments
Payments are generally made by the assigned collection partner/kabadiwala directly to the user. KabadCart:
- is not liable for payment disputes between users and collection partners,
- does not guarantee payment timelines,
- and may only facilitate communication and support where possible.
7. User Conduct
Users agree not to:
- provide false information,
- misuse the Platform,
- engage in fraudulent activities,
- upload harmful content,
- abuse staff or collection partners,
- or attempt unauthorized access to systems.
8. Prohibited Items
The following may not be sold through the Platform:
- stolen goods,
- illegal materials,
- hazardous waste,
- biomedical waste,
- explosives,
- weapons,
- or restricted substances.
KabadCart reserves the right to reject or report suspicious transactions.
9. Intellectual Property
All Platform content including:
- branding,
- logos,
- graphics,
- software,
- content,
- and designs
remain the property of KabadCart or respective licensors. Unauthorized use is prohibited.
10. Testimonials & User Content
Users grant KabadCart the right to use:
- reviews,
- testimonials,
- ratings,
- photographs,
- videos,
- and feedback
for marketing, promotional, branding, and business purposes.
11. Business Partnership Display
KabadCart may display logos and names of associated businesses, societies, institutions, and organizations to showcase trusted partnerships and collaborations.
12. Limitation of Liability
KabadCart shall not be liable for:
- pricing fluctuations,
- pickup delays,
- disputes with collection partners,
- payment disagreements,
- material quality disputes,
- indirect damages,
- loss of profits,
- or unauthorized transactions conducted outside the Platform.
13. Service Availability
KabadCart may:
- modify services,
- suspend operations,
- limit access,
- or discontinue features
without prior notice.
14. Account Suspension & Termination
KabadCart reserves the right to suspend or terminate accounts involved in:
- fraud,
- misuse,
- illegal activities,
- policy violations,
- or suspicious transactions.
15. Indemnification
Users agree to indemnify and hold harmless KabadCart from any claims, damages, liabilities, or disputes arising from:
- user misconduct,
- illegal scrap transactions,
- ownership disputes,
- or violation of applicable laws.
16. Governing Law
These Terms shall be governed by the laws of India. Any disputes shall be subject to the jurisdiction of competent courts in Rajasthan, India.
17. Changes to Terms
KabadCart reserves the right to update these Terms at any time. Continued use of the Platform after updates constitutes acceptance of revised Terms.
